PURPOSE: Make the lawsuit process accessible to people who want to directly manage their lawsuits, and save 90% of the typical cost of conflict resolution.  The overarching goal is the change the calculus for con-artists and harmful actors: if prospective victims have a means of standing up for themselves, harmful people will be less likely to attempt to hurt people.

NON-PROFIT MOTIVE AND STRUCTURE: The legal industry is a protected industry. People with less money are always at a disadvantage to those with large financial reserves.  Successful white-collar criminals often have a large financial reserve, and they utilize this financial strength along with the fact that victims are faced with immense non-recoverable expenses associated with fighting the fraud.

The good-guys outnumber the bad-guys, but the bad-guys are far more aggressive and determined.  By organizing and assembling a multitude of the good-guys; the bad-guys have less opportunity to hurt people and get away with it.  In the protected lawyer industry, there are enough honest lawyers who will be willing to donate their knowledge into a mechanism that can multiply the benefits of that knowledge across a broad spectrum of people in need.    Retired lawyers and judges can donate their time (and possibly get a tax deduction) in order to do good without having to be inside the conflicts.

Outmatched will be non-profit, and 100% transparent including transparency on the salaries of management and staff.  Individuals and Corporations will be allowed to donate and receive a tax deduction and publicize their support of this system.  In some instances, the Brand markings of large donors could be shown in the corner of the screen. 

TBD: If it is found to be acceptable in a non-profit environment, referral fees for some services listed through the Outmatched website could be used to support the site including promotion of the site through countries where the services can be of value.

SITE ENGINE: Outmatched.org is a blend of the (early) Amazon model and the Uber model.  

Similarities to the early Amazon model include a single search location to find the ideal product provider and fulfilment.  In Outmatched, the match is to a knowledge service rather than a physical product.   The knowledge service is primarily automated (Artificial Intelligence) that has learned from a law-entrepreneur(s).  There are no fulfillment costs, but rather every Need will be directed down to an AI ‘Customer Service’ system that has learned from a lawyer from the County/Provnce where matter will be tried who has expertise in the subject matter.   There are 3140 Counties in USA, and numerous Provinces around the world; each with their own legal rules.

Similarities to the Uber model includes matching legal-users to legal-providers on a moment by moment basis.  Filling short-term openings in Lawyers’ calendars with short-term legal needs of users, which could be businesses which are required to have a lawyer present before judges.  Uber performs gig-matching and payment-clearing for Providers with a Driver’s License and a Car.  Outmatched performs gig-matching and payment-clearing for Providers with a Legal License and a Computer.

Current buyers of $300/hr legal services have no idea how much their service provider DOESN’T KNOW.   The AI Lawyer combined with the mental horsepower of the Outmatched user will be superior to a $300/hr lawyer.  With certainty, the Outmatched user will care more about his or her outcome than any $300/lawyer they may find.  Worse, many legal clients are taken advantage of by their own lawyer.

FEATURES:

  1. Artificial Intelligence: The AI Advisor will know all of the written statutory law pertinent to the specific Matter.  Also, the AI Advisor will know all of the local Court rules.   Although lawyers want their customers to believe the law is complex, it isn’t – it’s black-and-white and perfectly suited to AI.    Outmatched will walk the user through all of the steps, forms, and processes required to file and prosecute a lawsuit start-to-finish. 
    1. By simply guiding/teaching the user who will be representing themselves, the Outmatched system will not be providing direct legal services. This is important for avoiding the regulations surrounding the legal practice.
    2. Case law is an integral part of more complex cases. Outmatched will NOT be focused on assisting users prosecute the more complex cases that would be referencing case law.
      1. In the event an Outmatched user wishes to prosecute a more complex case, offshore legal researchers (accessed via Outmatched) coupled with WestLaw research tools will enable user to very efficiently prosecute a complex case.
  2. Portal Lawyer: When necessary or desired, access to a ‘portal lawyer’ who reviews/transmits your written document on to the Court;. In some states Corporations are required to have a lawyer face the Court. 
    1. Small business owners may save 80% of their legal costs by doing the majority of the leg work via Outmatched., then bringing in a lawyer only for the face-to-face Court time.
  3. Offshore Advisor: Available offshore lawyers who are legally trained and can give advice / edit your documents; but not interface with the Court. Without Outmatched, customers are forced to pay $300/hr for a lawyer who may be incompetent.  In the Outmatched system, you’ll pay $30/hr for a lawyer in India/Asia who is rated and reviewed similarly to how products are rated on Amazon.
    1. Offshore advisors will be ranked/rated (including ratio of wins vs losses)
    2. Offshore legal research will be available for $20/hr.
  4. Remote Servicing: Videoconferencing with the lawyer makes physical location irrelevant. Driving/walking to a meeting is wasted time. A lawyer in India can be just as helpful as one around the block
  5. Staff Lawyers: In the event the Outmatched user wants more in-depth help; ‘staff lawyers’ (Independent Contractors integrated into the Outmatched app) are available for $150/hr. This can be gig-based or more long-term.  The Outmatched user retains control over the case. 
    1. Lawyers who wish to be included on the Outmatched site, will be required to donate to the non-profit Outmatched corporation, agree to a flat $150/hr rate, and agree to have their ratings listed on the Outmatched
  6. Professional Services: Each of the professional service providers (Court Reporters, Private Investigators, etc) will be briefly vetted via a phone interview, better business bureau check, and three references. These ‘key people’ will be required to donate and charge an hourly rate of ½ the ‘going rate’ to be on the org site.  As with all human service providers on Outmatched, the providers will be subject to the ratings/rankings system. 
    1. Expert witnesses in all areas: car accident, employment/employability,
    2. Private Investigators
    3. Court Reporters
    4. Process Servers
  7. Bulletin Board: Post information on scams, product failures, etc. This could lead to class-action lawsuits.  There will be functionality to help people organize into classes by themselves, then lawyers can bid on representing them; or they can represent themselves via the SelfSue.com system.   Major legal issues are spectator sports.
  8. Calendar: Reminders pushed to your smartphone (and linked smartphone app) to ensure you keep your suit on track. This ties in with Law-Proviers’ calendars.
  9. Publicity: A mechanism to inform the Press about a particular social-interest issue (scam). In order to limit the scope of irrelevant issues that get transmitted to journalists, users will be required to make a charitable donation for press releases.
  10. Collections: The site will walk you through the steps for collections (if the user desires).   org may provide collections services for a 20% commission on collected moneys.    The 20% will be considered a donation from the user – a way to give-back and support the site, so that it will remain viable for others.
    1. This feature also makes the site very ‘turn-key’ for the customer. From lawsuit filing to collections, it all happens seamlessly via the site/app.
    2. Collections services are a not a protected legal industry.
  11. Savings Ticker: Part of the joy of using Outmatched is saving thousands of dollars in legal fees, while being empowered to stand up and fight for yourself. Every user’s dashboard will include an estimate of the money they have saved.  The grand total of money saved from the Outmatched.org system will be continually updated on the site home page.
  12. War stories & tips: On each page about each step of the process for each state, users can submit content war stories & tips into a database. The content from the database will be randomly displayed on the respective page (entertainment for each click). 
    1. Professional content: submitted by lawyers that are registered with the site. This content can act as a form of advertising for the lawyer’s services, because the submitter of the ‘tip / knowledge’ can identify himself/herself.
    2. Amateur content: can be submitted by anyone as a way to advise and commiserate people in similar situtaions. Clients will feel like they are part of the process and will enjoy helping others through their experiences.
  13. Loneliness & Depression Prevention: Anyone who has been conned, traffick’d, or otherwise victimized will attest that it is a profoundly lonely experience. The victim is likely confused and humiliated; whereas the harmful actor is most-often seasoned in hurting people and understanding the means to get away with it.  Many victims don’t have family members who possess the capability to understand and help.
    1. Outmatched will give survivors an easy way to support others who are presently going through a suffering similar to their own. This will benefit both the past and present victims with a sense of community, understanding, and most-importantly a path to conquering
    2. In keeping with the Outmatched.org overall mission, the hope is that over time harmful people will come to know that their prospective-victims will be able to successfully fight-back. Thus, the calculus of harm will be shifted such that criminals will know that crime won’t pay.
  14. Human Trafficking & Human Rights: There are numerous funds, groups, systems, and ambitions to stem human trafficking and support human rights (specifically the rights of women in developing countries).  With our partners in Dubai, a segment of the Outmatched site will aggregate all of these disparate entities into one easy-to-use interface.   All of the elements of the Outmatched system will be incorporated as well.

CAPITALIZATION:   

  1. Org is intended to be a self-sustaining feature of the internet that thrives on the power of humans’ desire for fairness and peace.   Outmatched will issue one trillion shares (1,000,000,000,000); of which any one person or entity may only own one share.  The shares are financially worthless, but may have value to the person who decided to purchase the ‘share’. 
    The very large number of authorized shares is intended to send a message: Outmatched is for everyone, and no-one can exert control/influence over the site. 
    1. Org ‘shareholders’ will be listed on a page of the website, and corporate doners may publicize that they are “an Outmatched.org shareholder”.
    2. A person can acquire one share for any donation of $100 or more.
      1. Outmatched shares can be passed down to heirs, but not sold.
      2. It is expected that those who benefit from Outmatched.org will enthusiastically donate (and acquire a share)
    3. An entity can acquire one share for any donation of $10,000 or more.
      1. Outmatched shares can never be sold.
      2. If corporations choose to publicize that they are Outmatched shareholders, that will also help spread the word that this tool is available for victims.
      3. Although most victims suffer in silence, a large percentage of people have been victims of crimes (and could benefit from Outmatched.org). Corporations may benefit significantly from letting their customers know they are supporting such a tool.
    1. Donations from site participants (lawyers, professional service providers) will be a steady income stream. Those who prevail with the help of Outmatched.org will be asked to donate: in the spirit of paying it forward for someone else to benefit.
    2. 20% of judgement collections will be a substantial income stream. Although users will not be required to use this service, if a collections process is required it is expected that those who benefitted from Outmatched will near-100% choose to let Outmatched handle collections.
      1. Outmatched will be able to list those who are targets of collections on their website, which may have a shame factor in helping the collections process.

EDUCATION AND ONLINE CLASSES:

  1. Org will produce and offer free online classes to educate people on how to identify scams before becoming a victim and steps to take if they discover that they have been conned.

COSTS AND CONTENT CREATION:

  1. Outmatched will primarily be a volunteer-run organization. By keeping profit out of the equation, users can get the most cost-effective help possible.  Furthermore, by requiring those contributing to 100% or at least 50% donate their time/effort; there is a self-selection element.  Those wishing to profiteer from the hardships of others will choose to not be part of the system.
    1. There are reasonable places for profit in the world, but Outmatched is choosing to stand apart from that segment of society.
  2. Content and A.I. teaching for org will be provided by volunteer retired lawyers and judges who wish to give back. The self-selection process works again here.  Ill-intended lawyers won’t choose to give their time away for free.
    1. The Bar encourages active lawyer to do pro-bono work. Doing A.I. training and/or giving tips (education) to Outmatched users will be count towards active lawyers’ pro-bono work.  Pro-bono work isn’t a required by the Bar, so only genuinely well-meaning active lawyers will volunteer for Outmatched.
  1. The magic of Artificial Intelligence and Expert Systems is it allows the knowledge and expertise of one person to be multiplied hundreds of times over. This multiplication of effort is a legitimate ‘feel good’ for those contributing legal-learning.
    1. Those who contribute either by volunteering to help a particular Outmatched user, or those who help teach the A.I. Expert System will receive one Outmatched share (without having to donate money).
    2. Law firms may wish to promote on their websites: “Outmatched.org Shareholder”. This encourages participation and also helps spread the word.
  1. Those who can afford to hire lawyers will continue to do so, thus there is no inherent threat from the existence of org.

CONCLUSIONOutmatched.org takes the complexity and cost out of a lawsuit, so people are personally empowered to seek conflict resolution on their own.  A level playing field will not only help people who might otherwise feel helpless, but it will change the calculus for bad-actors.   The common phrase “Crime pays, that’s why there are so many criminals” reflects the present reality where people can’t fight back efficiently.  Outmatched puts the intended power of the law in the hands the 90%, which will change the calculus so that crime/fraud doesn’t pay.

Outmatched will improve the lives of numerous individuals and society as a whole through changing the overall calculus of crime.  When criminals can’t easily get away with it, they are far less likely to hurt people in the first place.
